Policy Proposals

Advocating for better AI governance is easy in the abstract. This is the text we are actually asking for — drafted, versioned, and open to argument.

What this section is, and what it is not

Everything here is a proposal drafted by the HAIA Foundation. None of it is enacted law, pending legislation, or legal advice. We publish these texts so they can be argued with — cite them, adapt them, or tell us where they are wrong.

International

Instruments meant to bind states to one another. No single country can set terms for systems that are trained in one jurisdiction, hosted in a second and deployed in a third.

Treaty / ConventionDraft

Framework Convention on Artificial Intelligence

A framework treaty establishing registration of advanced AI systems, pre-deployment evaluation, mandatory incident reporting, and a standing scientific review body — with obligations that bind the state where a system is trained, hosted, or deployed.

United States — Federal

Instruments for Congress and the federal courts, where most of the authority over interstate commerce and federal agency practice already sits.

StatuteDraft

Artificial Intelligence Transparency and Accountability Act

A federal statute requiring disclosure when automated systems make consequential decisions about people, independent audit of those systems, a safe harbor for good-faith researchers, and enforcement by the FTC, state attorneys general, and affected individuals.

Constitutional AmendmentDraft

Algorithmic Due Process Amendment

A proposed amendment to the Constitution of the United States establishing that no person may be deprived of life, liberty, or property by a determination made solely by an automated system, and guaranteeing notice, explanation, and human review in government proceedings.

How these are written

Drafting is one of our six programs, not a side activity. Governance frameworks fail when they are written apart from the people who have to apply them, so each of these documents is built around what can actually be audited and enforced rather than what reads well in a press release.

Every instrument carries a version and a status. A draft is genuinely a draft — if you think a clause is unworkable, or that we have the balance wrong, we would rather hear it before a legislature does. More about our policy development work.

Found a problem with the text?

Drafting errors, jurisdictional gaps, unintended consequences — tell us. A proposal nobody has stress-tested is not worth putting in front of a legislator.
